A little history

With the passage of the 2018 Farm Bill, hemp was separated and distinguished from marijuana, and industrial hemp with a concentration of 0.3% THC or less was legalized and removed from schedule I of the Controlled Substances Act — making hemp-derived CBD available for sale in all 50 states, and legal to have shipped through the mail to you.
Texas House Bill 1325 only reinforced that fact for Texans. But then things got complicated

Delta 8 is one of over 100 different cannabinoids found within the cannabis plant but not in any significant amounts — so the only way to appreciate the euphoric effect it could provide was to manufacture and synthetically convert it from CBD.
Delta 8 started to become incredibly popular as it seemed to be able to bridge the gap between federally legal hemp and federally illegal marijuana. While the “high” provided was definitely lighter, it was still more of a high than one could get with traditional CBD. And Texas lawmakers did not like that. So in October of 2020, the Texas Department of State Health Services attempted to ban any “THC isomers” and declare them schedule I controlled substances. In January 2021, that ban became official. And there has been a huge back and forth battle over the legality of Delta 8 ever since. While hemp-sourced Delta-8 carrying no more than 0.3% THC by dry weight is legal today, many Texans are nervous not knowing what tomorrow will hold.
